Please join us for a program discussing recent law enforcement trends, risks and organizational measures regarding Cross-Border Investigations in Europe and the U.S.
Panelists will give practical advice on how to deal with the issues and challenges of Cross-Border Investigations. Pre-Investigation preparations and challenges will be covered as well as how to conduct investigations in Europe and the U.S.. Reference will be made on how to handle investigation findings.
The program is perfectly suited for multinational Companies located in the United States, as well as law firms, financial advisors and consulting firms who advise them.
Topics to be addressed will include:
» Overview of Enforcement Trends in the U.S. vs. Europe
• A Summary of Enforcement Actions and Lessons Learned (Anti-Bribery, BSA and Money laundering, etc…)
• Leniency Program in European Antitrust Law
» Issues and Challenges of Cross-Border Investigations
• US: Few limitations on employer-led investigations
• Europe: No general obligation to conduct internal investigations, restrictions on investigations under the foreign law of the workplace
» Anticipatory Pre-Investigation Preparations and Challenges
• Draft and implement a global code of conduct and ethics
• The need to implement clear communications channels; Differences between the US & EU (witness interviewing, reporting, Privacy, disclosure, Safe Harbor)
Plus: Hands-on action & Draft investigation plan; Compare U.S. and EU restrictions on investigations; Compare Treatment of Attorney-Client Privilege.
